USE OF THE VEHICLE
1.1 Hiring party must only use the Vehicle on a road, which is properly formed and constructed as a sealed, concrete, metaled, or gravel road.
1.2 Hiring party must not, unless authorized in writing by BJ Car, drive or take the Vehicle outside of Islamabad & Rawalpindi.
1.3 Hiring party must:
(a) not allow the Vehicle to be used for any illegal purpose, race, contest, or performance test of any kind;
(b) not allow the Vehicle to be used to tow or push anything unless authorized by BJ Car;
(c) not carry more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle, or carry a greater load than that for which it was built;
(d) not be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the State or Territory in which the Vehicle is driven;
(e) not allow the Vehicle to be used to carry passengers for payment of any kind;
(f) not use the Vehicle when it is damaged or unsafe;
(g) not use the Vehicle to transport goods;
(h) not use the Vehicle for the conveyance or towing of any load which is incorrectly loaded or secured or is in excess of that for which the Vehicle was constructed;
(i) not, without BJ Car’s prior written consent, use the Vehicle to carry any inflammable substance which has a flash point under 22.8°C or any other explosive or corrosive substances; and
(j) not use the Vehicle in contravention of any law.
1.4 Haring party must pay for any unauthorized repairs to the Vehicle and for all parking and traffic infringements in respect of the Vehicle during the Rental Period.
1.5 Nobody is authorize to drive the vehicle expect the person holding an authority letter issued by the BJ Car.
1.6 For daily rental mileage of said vehicle is 150km per day & for monthly rental mileage is 4500km per month, extra mileage will be charged @Rs. 10/km
MAINTENANCE, SECURITY AND SAFETY
2.1 Hiring party must:
(a) maintain all of the Vehicle’s engine oils and engine coolant levels to the manufacturer’s specifications, as set out in the Vehicle’s operations manual located in the glove box;
(b) keep the Vehicle locked and the keys under Your personal control at all times.
(c) Keep the Vehicle neat & clean..
2.2 Hiring party must not have repairs to the Vehicle carried out unless BJ Car authorizes hiring party to do so. BJ Car requires verification of the cost of repairs for audit purposes. Hiring party should obtain an original invoice/receipt to assist BJ Car. BJ Car will reimburse hiring party for any repairs to the vehicle authorized by it, provided that the cost of those repairs is verified. To the extent that BJ Car cannot verify the cost of repairs; BJ Car will not reimburse the hiring party.
2.3 Hiring party must bring the car to BJ Car office for examination once in every month.
IN CASE OF ACCIDENT/DAMAGE OR LOSS
3.1 Hiring party will be bound to pay the loss of the vehicle up to Rs. 100,000 and if the loss exceeds this limit the minimum amount of Rs. 100,000 will have to be paid by the hiring party and also the depreciation charges by insurance company.
3.2 In case of total loss or theft, hiring party will be bound to pay the rent during the period of final payment from the insurance company and also pay the depreciation charges by insurance company.
3.3 In case of any mechanical problem in the vehicle and/or for maintenance, BJ Car will provide an alternative vehicle to haring party with similar specifications free of charge. I the vehicle in replaced due to an accident, then hiring party shall pay the rent of both (replaced and accidental) vehicles during the days in which the accidental vehicle remained under repair.
3.4 Haring party will be responsible for carriage of goods etc. if any contraband items are carried, BJ Car will not be a party to meet or accept any responsibilities is or entertain any claims for any damages sustain by the third parties.
3.5 The hiring party will be responsible and legally bound for release of vehicle if impounded for violation of any law/rules. Instituting/defended any suit in any court of law in respect of the vehicle is in question.
3.6 BJ Car does not accept any responsibility what so ever for any consequences arising, out or from the possession of the hired vehicle due to any reason misuse, violation of law, accident, fire, theft etc, it will be exclusively hiring party’s responsibility to meet all eventualities arising, out of possession of the car with the party.
3.7 In case of accident, if the vehicle is not in position to drive, hiring party will be responsible to pay the towing charges to BJ Car.
3.8 In case of total loss/theft, hiring party will be bound to pay the registration charges of said vehicle which paid by BJ car/Car Owner for registration.
CLAIMS AND PROCEEDINGS
- Where the use of the Vehicle by hiring party results in an accident or claim, or where damage or loss is sustained to the Vehicle, hiring party must:
(a) promptly report such incident to the local police;
(b) promptly report such incident in writing to BJ Car
(c) BJ Car may use hiring party’s name (CNIC, License or passport copy) for insurance claim.
FUEL & LUBRICATIONS
5.1 The cost of fuel is not included in the rental rate. Rental vehicles are supplied with a full tank of fuel and should be returned full, otherwise a re-fuelling charges will applied.
5.2 In case of monthly use hiring party will be responsible to change vehicle’s engine oil and oil filter after each and every 2500km for diesel and 4500 km petrol vehicle.
RETURN OF VEHICLE
6.1 Hiring party return the Vehicle to BJ Car:
(a) to the place, on the date and by the time shown on the Rental Document;
(b) in the same condition as it was at the commencement of the Rental Period, fair wear and tear excepted.
6.2 Hiring party must return the Vehicle to a BJ Car location during normal business hours. If Hiring party returns the vehicle later than the time shown on the rental document, Hiring party must pay all additional rental charges.
6.3 if:
(a) Hiring party return the Vehicle on a date, or at a time, or to a place other than that shown on the Rental Document; or
(b) any special conditions set out in the “Rates” section on the Rental Document are breached, the rates shown on the Rental Document will not apply and hiring party must pay the BJ Car standard rate for the Vehicle for the Rental Period.
6.4 BJ Car may request the immediate return of the Vehicle, or BJ Car may re-take the Vehicle without notice, if BJ Car reasonably suspects that:
(a) Hiring part has breached a term or condition of the Rental Agreement;
(b) damage to the Vehicle, or injury to persons or property is likely to Occur; or
(c) the Vehicle will be involved in an industrial dispute; and
(d) the Vehicle may be used for an unlawful purpose;
Hiring party must also pay BJ Car any cost it incurs as well as all costs and charges under the Rental Agreement for the period up to return/repossession of the Vehicle.
PAYMENT
7.1 BJ Car accepts major credit cards. A security deposit is required in all cases. A credit card is required to process the security and insurance deposits. Payment is made in full when the car is collected and at the end of the Rental Period, hiring party must pay BJ Car on demand:
(a) all charges specified on the Rental Document and all charges payable under the Rental Agreement:
(b) any amount paid or payable by BJ Car or Hiring party to any person arising out of Your use of the Vehicle or imposed on hiring party or BJ Car by any governmental or other competent authority (such as speeding, parking and traffic fines); and
(c) any amount for which hiring party is liable to BJ Car under the Rental Agreement, in respect of a breach of the Rental Agreement or otherwise. BJ Car will provide details to hiring party of any amount payable under this clause 7.1(c).
7.2 The minimum charge hiring party must pay for the rental of the Vehicle is an amount equivalent to:
(a) one day’s rental at the “daily rate” shown on the Rental Document (subject to clause 4.4).
7.3 Hiring party authorize BJ Car to charge all moneys payable to BJ Car under the Rental Agreement to hiring party’s credit card or charge account.
7.4 The minimum period of self rental is 2 days, effective from commencement of rental. Rental charges are calculated on a 12 hours = 1 day basis, and extra hours are liable to additional charges. Extensions of rentals must be approved by the rental office concerned.
7.5 BJ Car will pay, within a reasonable time, any refund due to hiring party by such method as BJ Car may reasonably choose.
7.6 If hiring party fail to pay any money due under or in connection with the Rental Agreement within 7 days of the date by which hiring party was required to pay the money:
(a) Hiring party must also pay BJ Car services charges at 10% (compounded daily) on the money from the expiry of 7 days from the date on which hiring party was required to pay the money to the date of payment; and
(b) if BJ Car arranges for the collection of the unpaid money from hiring party by a debt collection agency, hiring party must also pay BJ Car:
(1) BJ Car administration fee of Rs. 4,000; and
(2) the debt collection agency’s fee equal to 10% of the unpaid money, in addition to the interest payable.
TERMINATION
8.1 Either party may terminate the Rental Agreement at any time if the other party commits a material breach of the Rental Agreement.
8.2 Hiring party may terminate the Rental Agreement at any time for any other reason [clause 6.3 will be applied).
8.3 If the Rental Agreement is terminated early for any reason other than a breach by BJ Car, hiring party agree to pay rental charges that reflect the actual duration of the rental. Such charges may be higher than those that apply for a longer rental period.
